In connection with the rapid development of crime that can be observed in recent years, a solution that would effectively combat this phenomenon needed to be found. By the Act of June 25, 1997, the State’s Evidence Act was passed; the Act introduced a solution granting a prize in the form of not being liable to punishment for committed crimes in exchange for help in disclosing the circumstances of the offenses the state’s evidence has been aware of. The legislator, granting the state’s evidence immunity against punishment, forgot to secure the victim’s interest in the pursuit of civil claims resulting from the committed crime. A victim is basically deprived of the real possibility of pursuing civil claims from the state’s evidence. The obligation set in art. 3 par. 1 item 1 point b of the State’s Evidence Act introduced by the Act of July 22, 2006 shall be regarded as a positive solution that equalizes the chances of the weakened party, that is the victim. This regulation conditions granting of the immunity of the state’s evidence upon obligatory disclosure by the state’s evidence of their property and the property of other offenders referred to in art. 1 of the State’s Evidence Act. The article presents the position of a victim and their real chances of recovering the damage caused by the criminal group. A victim may pursue their civil claims directly from the state’s evidence, which is virtually impossible, due to the protection of personal data that is the state secret. A victim may also pursue their civil claims from other accomplices of the offense who, in the event of adjudicating the obligation to repair the damage caused, have a recourse claim against the state’s evidence.Pozycja Odpowiedzialność za zgodne z prawem wykonywanie władzy publicznej na zasadzie słuszności(Oficyna Wydawnicza AFM, 2009) Więzowska-Czepiel, BeataThe concept of liability of public authority based on the principle of equity was introduced into the Polish law under the article 5 of the Act of 15 November 1956, “On the Liability of the State for Damage Caused by State Agents” . The regulation of article 5 of the Act was transposed into the Civil Code of 1964 without major modifications. It covered liability of the state and local self-government units for damage inflicted by a tort of a functionary (article 419 of the Civil Code). By the amendment to the Civil Code of 2004, article 419 of the Civil Code was abolished and the new article 4172 of the Civil Code, which provides liability for lawful exercise of public authority based on considerations of equity, was introduced. Article 4172 of the Civil Code provides that if by lawful exercise of public authority an injury to the person was caused, the injured person is entitled to obtain a full or partial compensation as well as monetary compensation for moral losses, when it is evident from the circumstances of the case, especially from victim’s incapacity to work or his/her poor financial situation that compensation is required by the considerations of equity. The amendment to the Civil Code of 2004 has brought about essential changes in the regime of state liability. Under the present law, the decisive factor of liability is the character of the conduct that results in the damage. The domain of special state liability is limited to torts committed in the exercise of public powers. For its private economic activities the state is liable according to the general rules of civil law. This change - in comparison to the former regulations of liability of public authority based on principle of equity - is unfavourable for the injured party, especially as regards damage sustained in medical practice, as medical care of patients, in general, is not considered to belong to the sphere of public administration.Pozycja Re-Codifying Civil Law in Hungary(Oficyna Wydawnicza AFM, 2014) Fézer, TamásPierwszy węgierski Kodeks cywilny został przyjęty w 1959 roku, w czasach, w których niespecjalnie interesowano się ustanowieniem współczesnego trzonu prawa cywilnego. Tak czy inaczej, Ustawa IV z roku 1959 była względnie nowoczesnym osiągnięciem, które za sprawą wielokrotnych poprawek służyło potrzebom społeczeństwa obywatelskiego przez ponad pół wieku. Na wczesnym etapie reorganizacji reżimu konstytucyjnego na Węgrzech po transformacji w 1989 roku rząd zakomunikował potrzebę ustanowienia nowego, zrewidowanego Kodeksu cywilnego. W 1989 roku powołano także specjalną komisję, która miała opracować podstawy teoretyczne przyszłego kodeksu. Niniejsza praca ma na celu opisanie podstawowych kwestii i teorii leżących u podłoża nowego kodeksu, a także przedstawienie okoliczności i potrzeb, które doprowadziły do przyjęcia nowego Kodeksu cywilnego na Węgrzech, czyli Ustawy V z 2013 roku. W poniższym tekście przedstawiono pewne ważne zmiany w zakresie koncepcji regulacyjnej Kodeksu cywilnego, podkreślając kilka teoretycznych i doktrynalnych nowości w dziedzinie prawa prywatnego, a szczególnie w zakresie prawa osób oraz odpowiedzialności za szkodę wynikłą z naruszenia zobowiązań wynikających z zawartej umowy.Pozycja Studia Prawnicze.
